OVERVIEW

Welcome to Rukhsar.

The terms “Rukhsar,” “we,” “us” and “our” refer to Rukhsar, operating from Vancouver, British Columbia, Canada.

Rukhsar operates this website and online store, including the information, content, features, tools, products and services made available through it (collectively, the “Services”).

Our store is powered by Shopify, which provides the ecommerce platform that enables us to offer our products and Services to you.

These Terms of Service, together with our Privacy Policy, Shipping Policy, Return, Refund & Exchange Policy and any other policies referenced on our website, govern your access to and use of the Services and purchases made from Rukhsar.

By accessing our website, creating an account, placing an order or otherwise using the Services, you agree to these Terms.

If you do not agree, you should not use the Services.

Nothing in these Terms limits or excludes any consumer rights or remedies that cannot legally be limited or excluded under applicable law.

1. ELIGIBILITY & ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your province, state, territory or country of residence, or otherwise legally capable of entering into the transaction.

You agree to provide accurate, current and complete information when placing an order or creating an account.

You are responsible for safeguarding your account credentials and for activity conducted through your account.

You must notify us promptly if you reasonably believe your account has been accessed without authorization.

You may not transfer, sell or assign your Rukhsar account to another person without our permission.

2. PRODUCTS & PRODUCT REPRESENTATION

We make reasonable efforts to describe and photograph our jewellery accurately.

However, jewellery is highly reflective and its appearance can vary depending on photography, lighting, surrounding colours and the device used to view our website.

Accordingly, minor differences may occur in:

  • Colour

  • Tone

  • Shine

  • Reflection

  • Texture

  • Finish

  • Stone or bead appearance

  • Enamel

  • Decorative detailing

  • Dimensions

  • Weight

  • Placement or alignment of decorative elements

Display settings, screen brightness, colour calibration and different devices can also affect how a product appears online.

Minor differences of this nature are not necessarily defects.

Where individual pieces contain materials or production processes that naturally create variation, no two pieces are guaranteed to be completely identical unless expressly stated.

Nothing in this section permits Rukhsar to materially misrepresent a product or limits mandatory rights relating to goods that are faulty, damaged, materially different from their description or otherwise non-compliant with applicable law.

3. JEWELLERY MATERIALS, CARE & WEAR

Customers are responsible for reviewing the materials, dimensions, weight, care instructions and other information provided on the applicable product page before purchasing.

Unless specifically represented otherwise, fashion jewellery can experience changes over time including:

  • Tarnishing

  • Oxidation

  • Patina

  • Surface scratching

  • Gradual fading

  • Gradual plating or finish wear

The rate of change can depend on frequency of wear, storage, climate, skin chemistry and exposure to substances including:

  • Water

  • Perspiration

  • Perfume

  • Hairspray

  • Lotions

  • Cosmetics

  • Household chemicals

  • Cleaning agents

Normal deterioration resulting from wear, improper storage, accidents, misuse or failure to follow reasonable care instructions is not considered a manufacturing defect, except to the extent applicable law provides otherwise.

Customers with known sensitivities or allergies should review available material information carefully before purchasing or wearing jewellery.

If irritation occurs, discontinue use.

Nothing in these Terms excludes liability that cannot legally be excluded for unsafe or defective products.

4. PRODUCT AVAILABILITY

Products may be available in limited quantities.

We reserve the right to:

  • Limit quantities

  • Discontinue products

  • Modify product specifications

  • Restrict sales by customer or geographic market

  • Correct inventory errors

at any time, subject to orders already legally binding upon us and applicable law.

Adding an item to your cart does not reserve inventory.

5. ORDERS

Submitting an order constitutes an offer to purchase from Rukhsar.

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that we have finally accepted the order.

To the maximum extent permitted by law, we reserve the right to decline or cancel an order before fulfilment for legitimate reasons including:

  • Inventory errors

  • Pricing errors

  • Payment authorization problems

  • Suspected fraud

  • Suspected unauthorized payment use

  • Unusual order activity

  • Resale activity

  • Shipping restrictions

  • Customs or legal restrictions

  • Product availability

  • Technical errors

  • Incorrect product information

If we cancel an order after payment has been collected, we will refund the amount collected for the cancelled merchandise as required by applicable law.

We may contact you to verify information before accepting or fulfilling an order.

Failure to provide information reasonably required to verify an order may result in cancellation.

6. PERSONAL USE & RESALE

Unless we provide written approval otherwise, products purchased through Rukhsar are intended for personal or household use.

You may not purchase products for unauthorized commercial resale, systematic redistribution or export in violation of applicable laws.

We reserve the right to limit or cancel orders that reasonably appear to be placed by unauthorized resellers or distributors.

7. ORDER CHANGES & CANCELLATIONS

Orders can enter processing soon after being submitted.

If you need to request an order change or cancellation, contact:

as soon as possible.

We will make reasonable efforts to assist, but changes or cancellations cannot be guaranteed once processing or fulfilment has begun.

Once an order has shipped, it cannot normally be cancelled through our standard cancellation process.

Any mandatory cancellation rights available under applicable consumer law remain unaffected.

8. PRICES & CURRENCY

Product prices may change without notice.

The price applicable to an accepted order is generally the price displayed when the order was placed, subject to correction of genuine pricing, technical or system errors where permitted by law.

Prices may be displayed in Canadian dollars or another currency depending on your location and store configuration.

Currency conversions may be performed by Shopify, our payment processors or other service providers.

Your bank or card issuer may independently apply currency-conversion charges or foreign transaction fees.

Rukhsar does not control fees imposed independently by your financial institution.

9. PRICING ERRORS

Despite reasonable efforts, pricing or product information may occasionally contain errors.

If a product has been materially mispriced because of a typographical, system, technical or data error, we reserve the right, where permitted by law, to:

  • Correct the error

  • Cancel the affected order

  • Contact you before processing the order

If an affected order is cancelled after payment has been collected, the amount collected for that cancelled purchase will be refunded.

Rukhsar is not required to fulfil an obviously erroneous price where applicable law permits cancellation.

10. TAXES, DUTIES & IMPORT CHARGES

Taxes, shipping charges, duties and import charges are handled according to the destination, applicable law and the shipping method used.

Applicable amounts collected by Rukhsar will be shown at checkout where supported.

Canada

Canadian orders may be charged applicable federal or provincial sales taxes as required.

Orders shipped domestically within Canada are not international imports.

United States

Where applicable U.S. duties or import taxes are calculated and collected at checkout, Rukhsar may ship the corresponding order using a Delivered Duty Paid (DDP) service in accordance with our Shipping Policy.

United Kingdom

Rukhsar does not currently offer United Kingdom shipments on a universal Delivered Duty Paid basis.

Taxes required to be collected by Rukhsar at the point of sale may be charged at checkout.

Other applicable:

  • Import VAT

  • Customs duties

  • Brokerage charges

  • Customs-clearance charges

  • Carrier handling charges

that have not been collected by Rukhsar may remain the responsibility of the recipient.

International customers are responsible for reviewing our Shipping Policy before ordering.

Customs authorities ultimately determine applicable classification, valuation, duties and import taxes.

Rukhsar does not control decisions made independently by customs authorities.

11. SHIPPING & DELIVERY

Shipping options, rates and available services are described in our Shipping Policy and/or displayed during checkout.

Delivery dates and transit times shown on the website or provided by shipping carriers are estimates unless expressly stated otherwise.

Delivery may be affected by circumstances outside our reasonable control, including:

  • Carrier delays

  • Weather

  • Customs processing

  • Government action

  • Service interruptions

  • Labour disruptions

  • Peak shipping periods

  • Natural disasters

  • Incorrect customer-provided information

Rukhsar is not responsible for delays caused solely by events outside our reasonable control, subject to any responsibility imposed by applicable consumer law.

Nothing in these Terms transfers the risk of loss to a consumer earlier than permitted by applicable law.

Customers are responsible for providing a complete and accurate delivery address.

Additional costs caused by incorrect or incomplete customer-provided delivery information may be charged or deducted from an otherwise eligible refund where permitted by law.

12. REFUSED, UNCLAIMED & UNDELIVERABLE ORDERS

Refusing a shipment does not automatically create an entitlement to a full refund.

Where an order is returned because:

  • Delivery was refused

  • The shipment was left unclaimed

  • Customer-payable import charges were not paid

  • An incorrect or incomplete address was supplied

  • Delivery could not be completed for reasons attributable to the recipient

Rukhsar may deduct non-recoverable costs from any refund otherwise due, to the extent permitted by applicable law.

These may include:

  • Original shipping

  • Return shipping

  • Customs charges

  • Duties

  • Tariffs

  • Brokerage charges

  • Carrier fees

Any eligible refund may be processed after the merchandise has been returned to and inspected by Rukhsar.

13. RETURNS, REFUNDS & EXCHANGES

Purchases are subject to our Return, Refund & Exchange Policy, which forms part of these Terms.

Where permitted by law, certain Rukhsar jewellery may be:

  • Final sale

  • Non-returnable for change of mind

  • Subject to hygiene restrictions

  • Subject to specific return conditions

Pierced jewellery may have additional hygiene restrictions where supplied with a hygiene or tamper-evident seal.

Nothing in our return policy limits rights relating to merchandise that is faulty, damaged, incorrectly supplied or otherwise protected by mandatory consumer law.

Customers must not send unauthorized returns to Rukhsar.

14. PAYMENT

You represent that:

  • Payment information you provide is accurate

  • You are authorized to use the selected payment method

  • Charges properly incurred through your order will be honoured by your payment provider

Payments may be processed by Shopify Payments or other third-party payment providers.

We do not directly control payment-provider authorization decisions, banking processing times or card-network procedures.

We reserve the right to cancel or hold an order where payment cannot be verified or where there are reasonable indicators of fraud or unauthorized use.

15. PROMOTIONS, DISCOUNTS & GIFT CARDS

Promotions, coupon codes, discounts and gift cards may be subject to separate conditions.

Unless otherwise stated:

  • Promotions cannot be combined

  • Discount codes cannot be applied retroactively

  • Promotions have no cash value

  • Promotional terms may change before an order is placed

If separate promotional terms conflict with these Terms, the specific promotional terms govern that promotion.

Mandatory consumer rights remain unaffected.

16. INTELLECTUAL PROPERTY

The Rukhsar website and its contents—including, where owned or licensed by Rukhsar:

  • Brand names

  • Logos

  • Product names

  • Photography

  • Videos

  • Graphics

  • Text

  • Product descriptions

  • Page layouts

  • Designs

  • Artwork

  • Marketing materials

  • Collections

  • Trade dress

are protected by applicable intellectual-property laws.

Except where legally permitted, you may not without prior written authorization:

  • Copy

  • Reproduce

  • Republish

  • Modify

  • Distribute

  • Sell

  • License

  • Scrape

  • Systematically download

  • Create derivative commercial works from

  • Use for unauthorized commercial purposes

any protected Rukhsar content.

No ownership interest in Rukhsar intellectual property is transferred through your use of the Services or purchase of our products.

17. AUTOMATED ACCESS & DATA EXTRACTION

To the maximum extent permitted by law, you may not use automated systems to systematically access, scrape, extract, reproduce or commercially exploit the Services or Rukhsar content without written permission.

This includes unauthorized:

  • Bots

  • Crawlers

  • Scrapers

  • Data-mining systems

  • Automated extraction tools

Nothing in this section prohibits activity that cannot legally be restricted.

18. CUSTOMER REVIEWS, PHOTOS & OTHER CONTENT

If you voluntarily submit reviews, photographs, videos, comments, suggestions or other content to Rukhsar, you represent that you have the necessary rights to provide that content.

Unless otherwise agreed, you grant Rukhsar a non-exclusive, worldwide, royalty-free license to use, reproduce and display that content in connection with operating and promoting Rukhsar, subject to applicable privacy and consumer laws.

You must not submit content that:

  • Infringes intellectual-property rights

  • Violates privacy rights

  • Is knowingly false or fraudulent

  • Contains malware

  • Is unlawful

Rukhsar will not prohibit or penalize legitimate consumer reviews where doing so would violate applicable law.

19. THIRD-PARTY SERVICES & LINKS

Our Services may contain integrations, functionality or links provided by third parties.

These may include services relating to:

  • Shopify

  • Payments

  • Shipping

  • Analytics

  • Social media

  • Advertising

Third-party services may operate under their own terms and privacy practices.

To the fullest extent permitted by law, Rukhsar is not responsible for independent third-party websites, content, services or conduct that is outside our reasonable control.

20. RELATIONSHIP WITH SHOPIFY

Rukhsar is powered by Shopify.

Shopify provides technology and infrastructure that enables us to operate our online store.

However, purchases from the Rukhsar store are transactions between the customer and Rukhsar, not between the customer and Shopify.

Shopify is not the seller of Rukhsar merchandise.

21. PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy and applicable privacy laws.

Because Shopify hosts our store, certain information may also be processed by Shopify and other service providers necessary to operate our ecommerce business.

Please review our Privacy Policy for further information.

22. ERRORS, INACCURACIES & OMISSIONS

Occasionally, information on our Services may contain errors or omissions relating to matters including:

  • Product descriptions

  • Product availability

  • Pricing

  • Promotions

  • Shipping charges

  • Delivery estimates

  • Customs information

We reserve the right, subject to applicable law, to correct errors and update information.

Where legally permitted, we may cancel an affected order where a material error makes fulfilment unreasonable or impossible.

23. PROHIBITED USES

You may not use the Services:

  • For unlawful purposes

  • To violate applicable laws

  • To commit or facilitate fraud

  • To infringe intellectual-property rights

  • To transmit malware or malicious code

  • To obtain unauthorized access

  • To interfere with website security

  • To collect personal information unlawfully

  • To impersonate another person

  • To submit fraudulent payment information

  • To abuse promotions or return procedures

  • To engage in unauthorized commercial scraping or exploitation

We may suspend or restrict access where we reasonably believe these Terms have been materially violated.

24. SUSPENSION OR TERMINATION

We may suspend or terminate access to the Services where reasonably necessary because of:

  • Fraud

  • Illegal activity

  • Security threats

  • Material violations of these Terms

  • Abuse of our Services

Termination does not eliminate obligations that arose before termination.

Sections that by their nature should survive termination—including intellectual property, liability limitations and payment obligations—will continue to apply.

25. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the website and Services are provided on an “as is” and “as available” basis.

We do not guarantee that:

  • The website will always be available

  • Access will be uninterrupted

  • The website will always be error-free

  • Every technical issue will be corrected immediately

To the fullest extent permitted by law, warranties or conditions not expressly provided by Rukhsar are excluded.

Nothing in this section excludes statutory warranties, guarantees, conditions or consumer rights that cannot legally be excluded.

26. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Rukhsar and its owners, directors, officers, employees, contractors, service providers, agents and affiliates will not be liable for indirect, incidental, special, exemplary, punitive or consequential losses arising from use of the Services or purchase of our products.

This includes, where legally excludable:

  • Lost profits

  • Lost revenue

  • Lost business opportunities

  • Loss of anticipated savings

  • Loss of data

  • Indirect replacement costs

To the maximum extent permitted by law, Rukhsar's aggregate monetary liability arising directly from a particular order will not exceed the amount actually paid to Rukhsar for the product or order giving rise to the claim.

This limitation does not apply where liability cannot lawfully be excluded or limited, including where applicable for:

  • Fraud

  • Fraudulent misrepresentation

  • Wilful misconduct

  • Death or personal injury where liability cannot legally be excluded

  • Mandatory product-safety obligations

  • Mandatory consumer rights

  • Any other liability that applicable law prohibits us from excluding or limiting

27. EVENTS OUTSIDE OUR CONTROL

Rukhsar will not be responsible, to the extent permitted by law, for delay or failure caused by circumstances outside our reasonable control.

These may include:

  • Natural disasters

  • Severe weather

  • War

  • Terrorism

  • Civil unrest

  • Government action

  • Customs disruptions

  • Labour disputes

  • Carrier interruptions

  • Infrastructure failures

  • Widespread telecommunications failures

This section does not remove statutory rights relating to undelivered purchases or other rights that cannot legally be excluded.

28. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold Rukhsar harmless from third-party claims, losses or reasonable costs resulting directly from:

  • Your unlawful use of the Services

  • Your infringement of another person's intellectual-property rights

  • Fraudulent conduct by you

  • Your material breach of these Terms

This provision does not require a consumer to indemnify Rukhsar for Rukhsar's own negligence, unlawful conduct or obligations that cannot legally be transferred to the consumer.

29. SEVERABILITY

If any provision of these Terms is found unlawful, void or unenforceable, that provision will be enforced to the maximum extent legally permissible or severed where necessary.

The remaining Terms will continue in effect.

30. NO WAIVER

If Rukhsar does not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

A waiver of one breach does not constitute a waiver of another breach.

31. ENTIRE AGREEMENT

These Terms, together with the policies incorporated by reference, constitute the agreement governing your use of the Services and purchases through Rukhsar, subject to applicable law.

If a specific promotion or product-specific term conflicts with a general provision here, the more specific term will apply to that matter where legally enforceable.

32. ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent except where applicable law provides otherwise.

Rukhsar may assign or transfer its rights and obligations as part of a legitimate business transfer, restructuring, merger, acquisition or sale, subject to applicable law.

33. GOVERNING LAW

These Terms and transactions with Rukhsar are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict-of-law principles, to the extent permitted by applicable law.

To the extent legally permissible, disputes relating to these Terms or the Services may be brought before courts of competent jurisdiction in British Columbia, Canada.

Nothing in this section deprives a consumer of mandatory protections, remedies, jurisdictional rights or the ability to bring a claim in another forum where applicable consumer law requires otherwise.

Nothing in these Terms requires mandatory arbitration or prevents a customer from exercising rights that cannot legally be restricted.

34. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes in:

  • Our business

  • Our Services

  • Technology

  • Shipping arrangements

  • Applicable laws or regulations

The current version will be posted on this page with an updated effective date.

Changes will not retroactively remove rights that have already arisen where applicable law prohibits doing so.
